"FK Partizan is a club of all partisans, not two people who think they can do whatever they want with it"

Yugoslav Sports Association (JSD) Partizan announced today that no conditional resignation is legally possible without the consent of the Association itself, after the football club announced that it could do so due to certain decisions that could be made by the new Board of Directors of JSD Partizan.

"Football club Partizan is a club of all partisans, not a club of two people who think they can do whatever they want with it. FK Partizan is not anyone's private property, but there are legal norms regulated by the Statute of JSD Partizan, in which way any club can to withdraw from the Company, (Art. 24, paragraph 1 allows withdrawal from the Company but according to pre-determined procedures and with pre-determined consequences)", it is stated in the announcement of JSD Partizan.

Football club Partizan held a session of the Assembly last night, after which it announced that it will conditionally resign from JSD Ppartizan if the new Board of Directors of JSD Partizan, headed by the president of the basketball club, Ostoj Mijailović, who is not recognized by the football club, abuses its authority and makes decisions about the rights and obligations of the football club as member of the Society. It was announced from JSD Partizan that every club that withdraws from JSD Partizan is obliged to obtain the consent of the Society, but also to conclude an agreement on disaffiliation with the Board of Directors of JSD Partizan.

"In this way, mutual relations concerning the material and financial nature are regulated, as well as deadlines for the fulfillment of mutual claims are determined (Art. 24, paragraph 8). According to the Law on Sports (Art. 78, paragraph 7), each status "a change made in a sports club contrary to the law is legally null and void. The same law prescribes the obligation of a sports club that participates in a status change to prepare a financial report, and an auditor's report is also required (Article 79)," the announcement states.

Those provisions were entered into the Statute of JSD Partizan at the 55th session of the Assembly of the Company, which was held on March 31.03.2017, XNUMX. year, which was chaired by the president of the football club, Milorad Vučelić.

"It was Vučelić who proposed these changes with the explanation that in this way the Statute is harmonized with the Law on Sports from 2016. At the same time, it was also the last Assembly that was held until September 12, 2022," it added.

"It should be noted that Partizan's stadium is owned by JSD Partizan and can only be used by members of the Association. A club that withdraws from the Association loses the right to use the common name Partizan, the coat of arms of JSD Partizan (Art. 24, paragraph 7), and therefore the right on the use of common property," the announcement states.

JSD Partizan stated that the Assembly of the company, where the new leadership was elected by a majority of votes, was held in accordance with the law and that it is considered legal and legitimate, "regardless of the fact that such a situation does not suit individuals".

"According to all of the above, no conditional resignation of any club from JSD Partizan is legally possible, both according to the Law on Sports and the Statute of the Society. What is possible is that people in positions may resign if they wish. Due to arbitrariness the entire Society cannot be divided by individuals," the JSDP press release states.

The election session for the president of JSD Partizan was held on September 12, after which the previous president and president of FC Partizan Milorad Vučelić and his opponent Ostoja Mijailović declared victory.

Not long after, Mijailović was registered as the official representative of JSD Partizan in the Agency for Business Registers (APR), after which the management of JSD Partizan headed by Vučelić submitted criminal charges to the Prosecutor's Office for Organized Crime.
